Scamnetic Pty Ltd ACN 681 257 045 and its subsidiaries and related companies (we, our, us, Scamnetic AU) is a part of the Scamnetic Group, a technology company that provides consumers with leading software solutions designed to detect and protect them from scams (Scamnetic Solutions). The Scamnetic Solutions include (but are not limited to): 

  • Scan&Score: our solution which validates potentially fraudulent and scam communications;
  • IDeveryone: our solution which verifies identities quickly with enterprise-grade technology;
  • Scam Intervention: our solution designed to support individuals to recover from scams and protect their assets; and
  • Scam Education: our scam protection tips and resources.

 Who does this Privacy Collection Notice apply to?  

This Privacy Collection Notice applies if you are either:

  • an individual who has purchased a subscription to the Scamnetic Solution(s) on his or her own behalf (Customer); or
  • an individual who is authorised by a company or other legal entity (in their capacity as a customer of the Scamnetic Solution(s) to use the Scamnetic Solution(s) (User).

What personal information do we collect and how do we collect it?

 Scamnetic has collected, or will collect, your personal information in connection with our provision of, and your access and use of, the Scamnetic Solution(s). This includes:

  • personal and business contact details: we will collect your name, email address and phone number;
  • demographic details: we will also collect your postal address (post code, postal code, or ZIP code only);
  • biometric information: subject to obtaining your consent, we may collect your biometric information when scanning any images that you provide to us;
  • financial information including financial account details, debit card, or credit card information: we may collect your financial information; and
  • other personal information contained in emails, text messages and social media messages sent to us: if you are using the Scamnetic Solution(s) such as Scan&Score, we will scan the emails, texts, social media messages and other images you send to or otherwise authorise us to verify whether the message is legitimate or a scam communication and, in doing so, we may collect other forms of your personal information contained in those messages.

We may also automatically collect data in connection with your use of the Scamnetic Solution(s). (Usage Data). Usage Data may include the duration of your use of the Scamnetic Solution(s), time and date of your use of the Scamnetic Solution(s), Internet Protocol (IP) address, other forms of geolocation data, browser type, browser version, unique device identifiers and other diagnostic data. We may also collect information that your device sends whenever you use the Scamnetic Solution(s). In some cases this may constitute personal information and other times we cannot identify you.

It is also possible that we may collect some personal information about you from third parties.

Why do we collect, store and use your personal information?

 The purposes for collecting your personal information are to:

  • provide, maintain and improve the Scamnetic Solution(s), including to:
    • verify the identity of senders of potential scam messages and to prevent impersonation fraud / scams targeting our Customers and Users;
    • detect scams targeting our Customers and Users; and
    • monitor the usage of the Scamnetic Solution(s);
  • create and manage your account and registration as a Customer or User of the Scamnetic Solution(s);
  • provide our Customers and Users with customer support and assist with technical issues in respect of the Scamnetic Solution(s);
  • develop, comply and undertake our contract for provision of the Scamnetic Solution(s) including fulfilling administrative functions such as billing and processing Customer payments;
  • contact you by email, telephone, SMS or other equivalent forms of electronic communication regarding updates or informative communications related to the functionalities, products or the Scamnetic Solution(s), including security updates, when necessary or reasonable for their implementation;
  • provide you with news, special offers and general information about other goods, Scamnetic Solution(s) and events which we offer that are similar to those that you have already purchased or enquired about, unless you have opted not to receive such information; and
  • manage your requests to us.

We may also use your personal information to:

  • evaluate or conduct a merger, divestiture, restructuring, reorganisation, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by us is among the assets transferred;
  • comply with any of our legal obligations and regulations and respond to lawful requests and communications from law enforcement and other government officials;
  • respond to any complaints you make to us;
  • assist us to detect, prevent and address technical issues in respect of the Scamnetic Solution(s) and assist us to understand how you use the Scamnetic Solution(s);
  • manage our relationship with you;
  • prevent or investigate possible wrongdoing in connection with the Scamnetic Solution(s); and
  • assist us with other purposes such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and evaluate and improve our Scamnetic Solution(s) and your experience.

If your personal information is not collected, we may not be able to provide the Scamnetic Solution(s) to you.

Who will we share your personal information with?

We may disclose your personal information to:

  • our service providers which include contractors and other entities who we do business with to assist us in providing the Scamnetic Solution(s) to you;
  • financial institutions for fraud and scam prevention activities;
  • research partners including those that administer surveys or conduct research projects in partnership with us or on our behalf;
  • business partners to offer you certain products, Scamnetic Solution(s) or promotions;
  • our affiliates including our parent company, other Scamnetic Group companies, and any other subsidiaries, joint venture partners or other companies that we control or that are under common control with us;
  • regulatory bodies and law enforcement bodies to comply with our legislative or regulatory obligations;
  • a third party in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion or our business to another company; and
  • other third parties, if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency), to enforce our terms and conditions, protect our operations, rights, privacy safety or property and/or those of Customers or Users or otherwise or otherwise with your consent.

Are we likely to share your personal information overseas?

 As the Scamnetic Group operates internationally, we may from time-to-time transfer personal information to overseas recipients located in the United States or Canada. We will only do this where it is necessary or appropriate to achieve the purposes set out in this Collection Notice or our Privacy Policy, where you have provided your consent or where we are otherwise permitted to do so under applicable laws.
